Judiciary facing greatest crisis: SCBA

New CJ pledges to maintain harmony among 3 state organs

The newly appointed Chief Justice, Syed Mahmud Hossain, on Sunday said that he would do everything possible to establish rule of law and justice for all in the country.
He said that he would also work to maintain harmony among the three pillars of the state-the legislative, the executive and the judiciary.
"A country can march forward through mutual cooperation among the legislative, the executive and the judiciary. If there is any mistrust among these organs, the development may be jeopardised. So, I will always try to coordinate among these three organs of the state," the CJ made these comments at a felicitation programme held in the Chief Justice's courtroom of the Appellate Division in the morning.
Attorney General Mahbubey Alam and Supreme Court Bar Association (SCBA) President Advocate Zainul Abedin accorded the felicitation to the new Chief Justice.
According felicitations to the new Chief Justice, SCBA President Zainul Abedin said that the judiciary of the country is facing the greatest crisis today.
He accorded the new Chief Justice on behalf   
of the members of the SCBA.
"The ruling political party is controlling the lower judiciary in one hand and on the other the courts are passing tough time with the huge backlog of cases. Thousands of false cases are adding  regularly. At the same time there are lacking of efficient and neutral judges. That is why, litigants are in frustration and there is a lack of confidence in them," he claimed.
President of the Supreme Court Bar Association asserted  that because of too many false cases  the Supreme Court should make  bail and anticipatory bail  easy as a deterrent against false cases.
The Chief Justice said, "We shall work to build image of the court in such a manner so that the people can feel that they are all equal and they will get justice in accordance with the law. Therefore, faith and confidence of the people in the court will be stronger."
The formulation of a law for appointing the judges under Article 95(2)© of the Constitution is inevitable under the present context, he added.
"The backlog of the cases is a big problem. We have to work unitedly to solve this problem. Sincere assistance of the bar association is also necessary to this effect," the Chief Justice said.
He said, "The main force of a judge is honesty. The vanguard of his accountability is his own conscience. He will follow the Constitution only and the law of the land. He will have to exercise his judicial functions beyond anger and fondness."
The SCBA president also mentioned that, "How the way the Chief Justice of the country was terminated and as a result vacuum created throwing the judiciary in the greatest crisis."
"The precondition of the democracy is a free judiciary. But our judiciary specially the lower  judiciary is almost administered by the government administration. We think, this is one of the big challenges for you to rescue the judiciary from this trap," the bar President said.
"The country is facing a serious political instability. Some members of the law enforcing agencies are taking the opportunity of this instability by arresting and harassing the opposition political party workers and also the non-political persons. Some law enforcers filing false cases against them," he said.
Addressing the CJ, the SCBA leader also said, "Establishing the rule of law, protecting the human rights, securing the independence and fulfill the wounds of the judiciary will be the big challenges in front of you."
President Md Abdul Hamid on February 2 appointed Justice Syed Mahmud Hossain the new Chief Justice. The following day he took oath as the 22nd Chief Justice of the country. He will stay in the office till December 30 in 2021.
Bangladesh Bar Council Vice-President Advocate Abdul Baset Majumder, Supreme Court Bar Association's former Presidents Barrister Mainul Hosein, Advocate Khandker Mahbub Hossain, and Advocate Yousuf Hossain Humayun, Bar Secretary Barrister A M Mahbub Uddin Khokan and other senior and junior lawyers were present on the occasion.
